A House in Multiple Occupation (HMO) is broadly defined as a property rented by three or more people from two or more separate households who share facilities such as a kitchen or bathroom. Since mandatory licensing was extended in October 2018, any HMO with five or more occupants from two or more households — regardless of how many storeys it has — requires a mandatory HMO licence from the local authority. Failure to hold the correct licence can result in civil penalties of up to £30,000, a rent repayment order requiring you to return up to twelve months of rent, and a potential ban from letting properties altogether.

Licensing Requirements and Standards

To obtain and maintain an HMO licence, landlords must demonstrate that the property meets minimum room size standards (at least 6.51 square metres for a single adult, 10.22 square metres for two adults sharing), adequate fire safety provisions including interlinked smoke and heat alarms, a fire door to every habitable room, and satisfactory cooking and washing facilities proportionate to the number of occupants. Many councils have also introduced Additional Licensing Schemes that extend licensing requirements to smaller HMOs — properties with three or four occupants — so it is essential to check your specific local authority's requirements rather than relying on the national minimum rules alone.

Staying Ahead of Compliance

The most effective way to manage HMO compliance is to treat it as an ongoing operational process rather than a one-off exercise. Conduct annual audits of fire safety equipment, EICR certificates (which must be renewed every five years), gas safety checks (annually), and room measurements.
